David M. Gallagher focuses his practice on business disputes with an emphasis on intellectual property matters. He litigates cases for clients in a broad range of industries, including apparel, aerospace, dry goods, gaming, insurance, military contracting, security and surgical devices.
Mr. Gallagher is experienced in all stages of the litigation process in both state and federal court from pre-filing strategy through appeal. Selected representative matters include—
- representation of companies in various matters in which favorable outcomes were obtained through dispositive motions before trial
- representation of a military contractor in a trademark, trade secrets and unfair competition case in which a complete defense verdict was obtained for the client
- representation of an apparel company on an equitable indemnity claim arising from a judgment in a copyright and trademark infringement action in which a grant of summary judgment against the client was overturned on appeal before the California Court of Appeal
- representation of an apparel company in a copyright and trademark infringement case in which an extremely favorable settlement was obtained after oral argument before the 9th Circuit.
Mr. Gallagher received his J.D. from Harvard Law School in 2004 and an M.Phil. from Oxford University in 2001. In 1997, he graduated from Sarah Lawrence College, earning a B.A. in literature and philosophy.
