Daniel Moffett’s practice encompasses all aspects of intellectual property procurement and protection, with a focus on complex patent and trademark litigation.

Mr. Moffett has experience in all aspects of patent infringement litigation, including case preparation, discovery, expert preparation, claim construction, patent reexamination, trial preparation, trial, and post-trial. He also has pretrial and trial experience representing clients in federal trademark infringement and unfair competition matters, as well as trademark matters before the Trademark Trial and Appeal Board. In connection with these litigation matters, Mr. Moffett has taken and defended numerous depositions, including defending critical expert depositions, argued before the court, and successfully briefed critical claim construction disputes and summary judgment motions. Mr. Moffett’s litigation experience involves a diverse group of clients, including clients in the medical device, biotechnology, database software, Internet software, retail grocery, restaurant, and entertainment industries.

In addition to litigation, Mr. Moffett’s practice includes initiating and defending inter partes and ex parte patent reexamination proceedings; prosecution of trademark and patent applications; licensing and assignment of patents, trademarks, copyrights and other intellectual property; and counseling clients regarding intellectual property matters. His experience in these areas includes participating in all aspects of patent reexamination proceedings and appeals, including in the fields of software and biotechnology; drafting and negotiating complex licenses for clients in a wide range of industries, including medical device manufacturing, biotechnology, civil engineering and retail; performing trademark-clearance and patentability analyses, including detailed review and analysis of patents relating to mobile device applications; and drafting and prosecuting patent applications in various industries, including pharmaceutical, software, advertising, and civil and environmental engineering.

In 2012, Mr. Moffett was named a “Rising Star” in a survey of Texas lawyers designed to identify the top young lawyers in Texas. Mr. Moffett received his B.S. in microbiology in 2000 and his J.D. with high honors in 2005 from the University of Texas at Austin. At the University of Texas School of Law, he was an articles editor on the Review of Litigation and a member of the Order of the Coif. Mr. Moffett is a member of the State Bar of Texas, the American Bar Association, the American Intellectual Property Law Association and the San Antonio Young Lawyers Association. He is registered to practice before the U.S. Patent and Trademark Office and admitted to practice before the U.S. district courts for the Eastern, Northern, and Western Districts of Texas and the U.S. Court of Appeals for the 5th Circuit.

Mr. Moffett actively serves as the Co-Sponsorship Chair for the Annual St. Jude Texas Hold ‘Em Tournament and Benefit, which raises money for St. Jude Children’s Research Hospital, and chairs the San Antonio office’s Associate and Counsel Committee.
