David Odom's practice focuses on all aspects of intellectual property including patent, trademark, copyright matters and litigation support. Mr. Odom provides his clients with procurement and enforcement of their intellectual property rights, both in the United States and abroad. His areas of practice include preparation and prosecution of patent, trademark and copyright, trade secret counseling, IP due diligence and all areas of IP licensing and contract drafting/negotiation.
Mr. Odom has a broad range of experience with technology comprising areas such as analog, digital and RF circuitry, microprocessors, software, electro-mechanical devices, device packaging, orthodontic devices and methods, mobile telecommunication devices and systems, computers, electrical wire/cable devices and methods of manufacture, aircraft related devices, night vision imaging systems, LED technology, movie theater design technology and construction technology.
Mr. Odom has also provided litigation support in various patent infringement cases in the mechanical and electrical arts in the United States. Additionally, he has also provided litigation support in various trademark infringement cases and has successfully handled trademark opposition and cancellation proceedings before the Trademark Trial and Appeal Board. Mr. Odom has represented a variety of inventors and corporations primarily in connection with their intellectual property transactional matters and needs and also in support of their litigation matters, all of which include, but are not limited to, the following—
- one of the nation's largest electrical wire and cable manufacturers in procurement of patents and trademarks to protect its technology and by providing litigation support when accused of patent infringement related to one of its electrical wire and cable products and its process of manufacture
- an orthodontic devices developer in procurement of patents and trademarks to protect and license its technology
- a major oil services company who is a world leader in premium tubular solutions primarily serving the energy markets in a variety of patent and trademark matters relating to its related technologies
- an international wireless telecommunications company in its preparation and prosecution of patents for its technology
- a multinational movie theater chain in the procurement of trademarks and copyrights worldwide to protect its brand and by providing litigation support when accused of patent infringement related to its movie theater construction and technology
- a multinational nutritional supplement company in the procurement of U.S. and international patents covering glyconutrients
- negotiated IP related matters in a $150 million joint venture deal with corporate counsel
- negotiated and drafted agreements and licenses in a $630 million sale of a large company.
Before attending law school, Mr. Odom served over 15 years in the U.S. Air Force and was a decorated commissioned officer, Gulf War veteran and an aircrew member flying supersonic B-1B bombers.
Mr. Odom received his B.S. in electronics, magna cum laude, from Chapman University in 1987 and his J.D. from Franklin Pierce Law Center in 2002. He is admitted to practice in the state of Texas, the U.S. Court of Appeals - 5th Circuit, the U.S. Court of Appeals - Federal Circuit, the U.S. District Court - Texas Eastern District, the U.S. District Court - Texas Northern District, and before the United States Patent and Trademark Office as a registered patent attorney. He is a member of the State Bar of Texas, the Dallas Bar Association, the American Bar Association (ABA), the American Intellectual Property Association (AIPLA), the Institute of Electrical and Electronics Engineers (IEEE) and the International Trademark Association (INTA). Mr. Odom has served for over five years on the board of directors of Woman Set Free, Inc., a women’s prison ministry.
Mr. Odom has co-authored two articles: “To Use or Not to Use, That Is the Question” (IRMI.com, April 2006) about the use of company logos without permission and “Practical Uses for Patent Reexamination with Concurrent Litigation.” Mr. Odom also served on the Texas State Bar CLE faculty for the 2011 Advanced Patent Litigation course and gave a presentation regarding the “Practical Uses for Patent Reexamination with Concurrent Litigation.”
