The Legal and Regulatory Landscape for Life Sciences 2012
Akin Gump Strauss Hauer & Feld LLP invites you to attend "The Legal and Regulatory Landscape for Life Sciences in 2012," a half-day seminar summarizing developments in the pharmaceutical and medical device industries. Topics will include—
Regulatory
We will be discussing some of the recent changes in health care fraud and abuse policies that are applicable to the life sciences industry, including changes promulgated by recent health care reform legislation and implemention of regulations. In addition, we will be addressing recent enforcement developments and what they mean for drug and device manufacturers.
Intellectual Property
Between unprecedented Supreme Court attention to patent cases, turnover in Judges at the Federal Circuit and the largest overhaul to the patent statute in over 50 years, the patent landscape has changed dramatically. We will discuss a “Top Ten List” of developments in the patent world that every life sciences company should be considering.
Antitrust
The pharmaceutical industry has become a major focus of antitrust regulators and plaintiffs’ attorneys. We will explore antitrust issues relating to the distribution of pharmaceutical products, including issues presented by the proposed Medco/Express Scripts merger. We will also discuss developments in antitrust law concerning settlement of Hatch-Waxman litigation and life-cycle management activities.
Ethics
In this session, we will analyze recent developments in government actions against in-house counsel and discuss how lessons learned from these actions can be applied. We will also review simple, but often-overlooked, steps that in-house counsel can take to minimize their personal liability.

Jorge Lopez, Jr. is the head of Akin Gump's health industry practice and a nationally recognized health care policy attorney, who has more than two decades’ worth of experience advising clients on a wide range of health regulatory and public policy issues.
Dianne B. Elderkin, a registered patent attorney, has over 30 years of experience advising clients in patent matters and litigating and trying patent cases involving a wide range of technologies, including biologic therapeutics, pharmaceuticals, medical devices, diagnostic methods and devices and consumer products. Ms. Elderkin has been inducted into the American College of Trial Lawyers and the International Academy of Trial Lawyers.
Mark Mansour works with clients in the food, pharmaceutical, medical device, dietary supplement and cosmetic industries to secure regulatory approvals, maintain compliance and address public policy issues in the United States and in key global markets.
C. Fairley Spillman represents pharmaceutical and health industry clients before the antitrust agencies and in court and counsels clients on a variety of complex antitrust issues, including potential issues arising from implementation of the Affordable Care Act.
Paul Hewitt provides antitrust/Hart-Scott-Rodino representation in hundreds of transactions involving such diverse industries and products as pharmaceuticals and medical devices, hospitals, managed health care, patents and other intellectual property, specialty chemicals, financial services and respirators, among others. Before joining Akin Gump, Mr. Hewitt was a trial attorney with the Federal Trade Commission Bureau of Competition, where he principally litigated merger and monopolization cases.
Katherine M. Katchen focuses her practice on complex class actions and other commercial litigation involving insurance, antitrust, health care, RICO, business torts, trade secrets, employment law, products liability and professional liability.
