The Journal of International Banking & Finance Law has published the article “Transferability: Does there need to be a re-balance?,” authored by Akin special situations & private credit partner Amy Kennedy and financial restructuring partner Liz Osborne and senior counsel Lauren Pflueger.

The article explores the current trend of loan transferability provisions such as restrictive “approved” lists and blanket restrictions on transfers to certain types of transferees. The authors reflect on the wider implications of these restrictions and reflect on whether they remain appropriate in today’s market landscape.
