For its article “Top Trade Cases To Watch In 2023: Midyear Report,” Law360 quoted Akin international trade partner Matthew Nicely for its section “Solar Panel Circumvention Probe Burns On,” which looks at the Commerce Department’s investigations of tariff circumvention, most notably in allegations that solar cell producers in Southeast Asia are serving as fronts for Chinese suppliers.

Law360 writes that the Commerce probe has not made much progress this year after a preliminary determination in December showed that half of the solar producers examined had, in fact, circumvented tariffs.

Matt said, “There are going to be several companies who will be able to continue to ship from Southeast Asia without duties because they either already have a different supply chain arrangement or they'll develop a different supply chain arrangement that will avoid circumventing activity.”
