Akin cybersecurity, privacy & data protection practice co-leader Michelle Reed appeared on TalksOnLaw to discuss the challenges and complexities businesses face in the digital era regarding data breaches and cybersecurity.
In the episode “After the Data Breach,” Michelle covers various topics impacting businesses as they navigate the labyrinthine of regulations governing data protection. She highlights the complex legal landscape that businesses face in terms of data protection and cybersecurity, in which laws and reporting obligations often overlap.
On that topic, she said, “[The United States is] regulated by industry, and our laws typically relate specifically to types of industries or specifically to states. At the federal level, you'll see laws regarding children's privacy, or you'll see laws regarding obligations for federal contractors or the final implemented laws for registered investment advisors and investment funds… [T]hen you have to trickle down to the states and see all of the state laws. And those state laws in the United States are all 50 states and three U.S. territories.”
