David Clonts and Michael Reeder, partner and counsel, respectively, in Akin Gump’s intellectual property practice, have written the article “Is the ‘Kessler’ Doctrine Still Needed in Patent Litigation?” which was published by The Legal Intelligencer.

The authors write that the rapid turnover of electronic consumer devices has shined a spotlight on the longstanding doctrine of claim preclusion in patent law. The article examines the Federal Circuit’s application of this doctrine over the years, citing several relevant court decisions. Clonts and Reeder conclude by noting the implications for practitioners.
