Jo-Ellyn Sakowitz Klein, senior counsel in Akin Gump’s health information privacy and security practice, tells Law360 that a recent Department of Health and Human Services (HHS) settlement shows that even small companies cannot evade the attention of HHS.

Klein was commenting on a case in which an Idaho hospice provider lost protected health information for fewer than 500 patients when a laptop computer was stolen. The hospice settled with HHS for $50,000, but Klein warned that she would “hate for people to think they don’t need to worry” just because they’re a small company. The settlement, she says, makes it clear that HHS “is going to investigate any small provider, all over the map.”
