In its article “Three High Court Justices Trusted Most With Divided Opinions,” Law360 discussed the U.S. Supreme Court justices who have the highest rate of writing majority opinions in contested cases during the 2013-14 term.

According to the article, every year each justice is responsible for writing approximately the same amount of opinions.  This Term, however, the types of opinions varied significantly. Looking at Justice Kagan, the article notes that she wrote seven opinions this year that yielded seven dissents and four concurring opinions and attributed this to others perceiving her as less polarizing than other justices. Akin Gump Supreme Court and appellate practice co-head Rex Heinke added, “I think the picture that a lot of people have on the court is that Kagan is on the liberal side, so there would be conservative dissenters. That was not borne out this term.”
