Jason Goldsmith’s practice focuses on litigation matters relating to creditor-side representations—for official committees, ad hoc groups and individual creditors—in all stages of complex chapter 11 bankruptcy cases. He specializes in prosecuting, defending and investigating case-critical adversary proceedings and contested matters.

Mr. Goldsmith’s recent high-profile engagements have included—

  • fraudulent transfer: In re Tribune Co.; In re Tousa, Inc.; In re Lyondell Chem. Co.; In re Bernard L. Madoff Inv. Sec. LLC; In re WCI Communities, Inc.
  • preferential transfer:  In re WCI Communities, Inc.; In re Tribune Co.
  • breach of fiduciary duty: In re Bridgeport Holdings, Inc.
  • plan confirmation: In re Chemtura Corp.; In re Tribune Co.; In re Calpine Corp.
  • § 363 sale/financing: In re Philadelphia Newspapers, LLC
  • §§ 502, 506 objection: In re Wellman, Inc.
  • appellate practice: In re Calpine Corp. (Federal district and circuit courts)

Mr. Goldsmith has also litigated and advised clients in a wide variety of commercial litigation matters, including creditors’ rights under state law, corporate officer/director liability and complex contract disputes.

Mr. Goldsmith received his J.D. magna cum laude from the University of Miami School of Law and his B.A. cum laude from the State University of New York at Purchase. While in law school, he served as articles and comments editor of the University of Miami Law Review, was champion of the Moot Court Board’s 2005 and 2006 annual appellate competitions and was elected to Order of the Coif. Mr. Goldsmith also served as a judicial intern to the Honorable Theodore Bandstra, chief magistrate judge for the U.S. District Court for the Southern District of Florida. He is the author of several articles on the topics of statutory construction and bankruptcy litigation.

Mr. Goldsmith is a member of the New York Bar and is admitted to practice before the U.S. Courts of Appeals for the 2nd and 3rd Circuits and the U.S. District Court for the Southern District of New York.
