Emily Johnson focuses her practice on district court and appellate patent litigation in the fields of biotechnology, medical devices and pharmaceuticals. Ms. Johnson has litigated cases across the country, involving a wide range of technologies, including contact lenses, antibodies, antacids, anticoagulants, migraine medications, antidepressants, polymers and consumer products. Ms. Johnson assisted in obtaining a favorable ruling at the Federal Circuit on behalf of a major diversified health care company, upholding a patent that maintained the company’s market exclusivity on a multibillion-dollar medication.

Ms. Johnson has substantial experience in appellate practice and procedure before the United States Court of Appeals for the Federal Circuit. She served as a judicial law clerk to the Honorable Arthur Gajarsa of the Federal Circuit and, in that capacity, gained experience in appeals from the federal district courts, the Board of Patent Appeals and Interferences, the Trademark Trial and Appeal Board, the International Trade Commission, the Court of International Trade and the Court of Federal Claims.

Ms. Johnson also has experience counseling clients regarding settlement, licensing and patentability opinions. In addition, she has mediated cases on behalf of the Center for Conflict Resolution in Chicago and is certified to mediate intellectual property disputes. Ms. Johnson’s pro bono matters include representing a Chicago playwright seeking to protect his screenplays and stage productions for his nonprofit theater company.

Ms. Johnson is a registered patent attorney licensed to practice before the U.S. Patent and Trademark Office. She earned her J.D. and LL.M. in intellectual property from the University of New Hampshire School of Law (formerly Franklin Pierce Law Center) and a B.S. in biology from Bucknell University.

Ms. Johnson is an active member of the American Intellectual Property Law and the Federal Circuit Bar associations. She has appeared as a panelist with Chief Judge Randall Rader concerning common mistakes in briefing and arguments before the Federal Circuit and how to avoid them. She has since been named an “Intellectual Property Leader” by the University of New Hampshire.
