Our labor and employment practice has experience that few other firms can match in dealing with labor-related issues in compact negotiations and protection of tribal sovereignty when labor unions seek to unionize tribal gaming organizations. In particular, labor unions have identified tribal gaming organizations as high-priority targets for unionization. Unions view tribal organizations not only as high-growth opportunities, but also as necessary components to protecting their traditional stronghold in the gaming industry. Because of these tribal organizations’ importance, labor unions have developed novel strategies to organize tribal gaming, working primarily through friendly legislators and governors to obtain favorable labor provisions in gaming compacts.

We also have assisted tribal clients in their efforts to have tribal governments included within the laws related to tax and retirement plans so that the tribes may receive the same benefits under these laws as states.
