“Navigating Artificial Intelligence in the Lone Star State: Biden’s Executive Order on AI,” an article by Akin cybersecurity, privacy & data protection practice co-head Michelle Reed and associate Amanda Hurd, has been published by The Texas Lawbook.
The article begins by discussing the October 30 executive order (EO) announced by President Biden—“Safe, Secure, and Trustworthy Development and Use of Artificial Intelligence”—and its components; the European Union’s 2021 EU AI Act and its provisions; and the EO’s plan of implementation and the challenges it may face.
The authors then examine the EO’s possible impact on Texas businesses, noting that “there are some direct considerations for providers and consumers of AI products and services.” The topics they cover are new reporting requirements, standards and restrictions; leveraging and supporting the development of AI tools; and consumer protection.
The authors close by concluding, “AI will have a profound effect on the burdens Texas businesses face as AI continues to advance into new spaces…Over the next several months, Texas businesses will have to adjust to U.S. agencies’ new regulations, as well as their effects on national, regional and multilateral efforts to regulate emerging AI technologies.”
