Bernd Janzen and Jean-Rene Broussard, partner and associate, respectively, in Akin Gump’s international trade practice, have authored the article “New Directions in the Perennial Struggle to Detect and Fight the Evasion of Antidumping and Countervailing Duties” for Global Trade and Customs Journal.

The article addresses the battle to combat the “unscrupulous foreign exporters and U.S. importers of goods” subject to antidumping and countervailing (AD/CV) duties. The authors first examine what has led to a renewed focus on the evasion of AD/CV duties. They then look at the roles of the Department of Commerce and U.S. Customs and Border Protection in administering and enforcing AD/CV duty orders. Finally, Janzen and Broussard discuss the various legislative proposals currently before Congress that would help the agencies combat the growing problem of AD/CV duty evasion.
