Intellectual Property & Technology Law Journal has published the article “CMS Proposes Several Changes to Reimbursement for Transformative Medical Technologies,” written by Matthew Wetzel and Heide Bajnrauh, senior counsel and senior policy advisor, respectively, at Akin Gump. Adapted from a client alert issued by the firm, the article analyzes a proposed rule change by the Centers for Medicaid and Medicaid Services (CMS) regarding reimbursement for transformative medical technologies.

Earlier this year, Wetzel and Bajnrauh write, CMS issued its fiscal year 2020 hospital inpatient prospective payment system, which addresses “many critical Medicare coding, coverage and reimbursement issues, including new medical technology that offers improved solutions for patients but that might add to the cost of a medical procedure or treatment.” Under the proposed rule, they note, CMS suggests several changes that “would likely result in increased payment for new and transformative medical technology and would also provide a mechanism for swift uptake in these settings.”
