Akin Gump Obtains Summary Judgment in Federal Suit against Nationwide Mutual Insurance

(Los Angeles) – The U.S. District Court for the Central District of California has ruled in favor of Akin Gump client Nationwide Mutual Insurance Co. and granted a request for summary judgment in the case Bikram’s Yoga College of India LP et al. v. Philadelphia Indemnity Insurance Co. et al.

The case centered on a dispute between plaintiff Bikram Choudhury and Nationwide, which provided an insurance policy to USA Yoga Federation, an organization established and run by Choudhury’s wife. The policy covers certain claims against volunteers and employees of USA Yoga, and Choudhury averred that Nationwide had a duty to defend him as an employee or volunteer of USA Yoga in an underlying third-party action filed by a former employee against him and his various business entities in state court for alleged acts of sexual harassment and defamation.

Choudhury alleged that Nationwide breached the policy by refusing his tender of defense. Nationwide contended that no duty to defend ever existed and that it did not breach the policy.
