Akin Gump Scores Trade Remedy Win for Westbay LLC

(Washington, D.C.) – The Department of Commerce has ruled in favor of Akin Gump client Westbay LLC in a case involving certain telescoping aluminum swimming pool poles that it imports. The ruling excludes the poles from the scope of the department’s antidumping/countervailing duty (AD/CVD) orders on aluminum extrusions from China.
Due to the increasing focus on evasion of AD/CVD orders, the Commerce Department has been reluctant of late to grant such exclusions, particularly in cases involving China. For Westbay, the decision removes years of continuing uncertainty and costs associated with antidumping/countervailing duties exposure and potential Customs and Border Patrol penalties.
