Bloomberg BNA Quotes Stephanie Webster on HHS Rulemaking, Medicare Payments Case
Bloomberg BNA’s Health Care Daily Report, in its article “Hospitals Look to Courts on HHS Rulemaking, Medicare Payments,” has quoted Akin Gump health partner Stephanie Webster.
The article reports that hospitals across the United States are waiting to see whether the Department of Health and Human Services (HHS) will appeal to the Supreme Court a court loss pertaining to Medicare payments worth potentially hundreds of millions of dollars. Last July, the U.S. Court of Appeals for the D.C. Circuit determined that the agency was required to undertake rulemaking for the prevailing Medicare rule on how disproportionate share hospital (DSH) payments are calculated.
Webster, who represents the plaintiff hospitals in the Allina case, said that litigation on the issue “could help determine the landscape going forward” for the process of Medicare policy changes.
