BNA Publishes New Edition of Don Livingston’s “EEOC Litigation and Charge Resolution”

Bloomberg BNA has published EEOC Litigation and Charge Resolution, Second Edition. This edition was written by Akin Gump labor and employment partner Donald R. Livingston with former Akin Gump partner Reed Russell, and with the help of friends who are specialists in EEO litigation. Mr. Livingston is a former EEOC general counsel.

The second edition was sparked by changes at the EEOC, which, the authors believe, is in the most experimental period of its history, with the agency’s litigation and investigation prerogatives being turned in new directions, as the EEOC seeks to expand the reach of the laws it enforces.

The new edition explains and provides examples of the types of provisions the EEOC seeks in conciliation and settlement agreements, updates chapters on the EEOC’s investigation and litigation practices, explains where and how decisions within the agency are made and provides pointers on how to influence EEOC decision-making during routine, “pattern or practice” and Commissioner charge investigations.
