Akin Gump international trade partner Christian Davis has been quoted by the Business Times in the article “The EU intends to restrict Chinese mergers and acquisitions in Europe, and semiconductors bear the brunt.” The article reports that European and U.S. companies are concerned about China’s overseas M&A activity, mainly because it is related to high-tech industries or advanced manufacturing.

As the article notes, the Trump administration earlier this year was considering cracking down on China’s investment in technology industries that the United States considers sensitive, including using national emergency laws to do so. The International Emergency State Economic Power Act, introduced in 1977, would allow President Trump to declare a state of emergency to deal with “unusual and serious threats.” He could then veto commercial transactions and freeze assets.

“This has never been used in cases involving unfair trade practices,” said Davis.
