Chip Cannon Authors Article on Impact of US Bulk-Power System Executive Order

POWER magazine has published the article “Industry Wants Clarity on Trump Order About Foreign Equipment,” written by Chip Cannon, head of Akin Gump’s energy regulation, markets and enforcement practice. The article discusses the response to an executive order (EO) by President Trump that declared a national emergency regarding the U.S. bulk-power system.
Cannon notes that the EO “prohibits U.S. persons from initiating transactions to acquire, import, transfer, or install ‘bulk-power system electric equipment’ that was designed, developed, or manufactured by a ‘foreign adversary,’ where the U.S. Department of Energy (DOE) has determined that the transaction poses an undue risk to the nation’s electric grid, critical infrastructure, or economy.” The electric industry, though, Cannon writes, has expressed concern about the order’s potential scope.
While DOE has tried to reassure various stakeholders that it is not “seeking wholesale replacement of components on the nation’s electric grid,” Cannon says some contend the EO is “having a chilling effect on investment and procurement decisions.”
