Corporate Counsel, in “Three Things to Know About Just-Released Proposed CFIUS Rules,” and Law360, in “Certain US Allies May See Expedited CFIUS Reviews,” quoted Akin Gump international trade partner Christian Davis on the significance of the proposed regulations.

The new rules, according to the publications, would expand requirements for review by the Council on Foreign Investment in the United States (CFIUS) and would also offer preferential treatment to nationals of certain countries.

Davis, whose practice focuses on guiding clients through, and advising them on, the CFIUS process, told Corporate Counsel and Law360 that the proposed regulations reflect CFIUS’s effort to implement the Foreign Investment Risk Review Modernization Act’s mandate even as it takes into consideration national security and business concerns. He added that the result is a much more complex regulatory regime that investors and businesses need to analyze.
