Corporate Counsel has quoted Akin Gump international trade partner Kevin Wolf in its article “Companies Aren’t Commenting on Future of Tech Export Controls: Why Not?” The article looks at what corporate America is—or is not—saying about proposed changes to the Committee on Foreign Investment in the United States (CFIUS) and how those changes will affect export controls on emerging technologies.
With just over a week remaining before the end of the initial comment period, the article reports that only about 40 comments had been submitted. Several of them, according to the article, rather than addressing export controls, instead asked the government to extend the comment period beyond the original December 19 deadline.
Wolf said about 60 percent of firm clients he works with are not commenting and there are three main reasons why: they are waiting to read the proposed rule; they don’t have time to comment; or they believe the process is meaningless.
“I’m optimistic and confident that career officials will take seriously the comments you want to submit. I have faith in the administration to pay attention to the quality of comments coming in,” Wolf said. He added that the “quality of the output from the government is going to be largely dependent upon the quality of the input from the industries.”
