The article examines the legal principles involved with employee selection screening as it relates to technology. While big data solutions can be attractive to employers, the authors question whether these approaches are legally defensible. Lander, Keapproth and their co-author David Jones, the founder of candidate assessment firm HRStrategies, discuss how employers should evaluate big data hiring solutions before using them. Failure to do so, they warn, could put one at risk of a successful challenge under Title VII of the Civil Rights Act.
