Power Finance & Risk has published an article by Akin Gump tax partner David Burton that looks at the benefits of, and applicable rules pertaining to, tax equity.

In “OCC Regulatory Benefits for Banks’ Tax Equity Investments,” Burton notes that, in addition to occasionally providing financial and tax benefits, tax equity also assists banks with meeting certain financial regulation requirements. Before making an investment, Burton advises that banks should obtain an informal ruling from the Office of the Comptroller of the Currency as to that investment’s eligibility under the Public Welfare Investment Authority.
