Don Livingston Quoted by Law360 on Upcoming EEOC Supreme Court Case

Law360, for its article “Labor And Employment Cases To Watch In 2015,” quoted Akin Gump labor and employment partner Don Livingston on an upcoming Supreme Court case looking at whether the Equal Employment Opportunity Commission (EEOC)’s conciliation efforts are subject to judicial review.

Livingston, a former EEOC general counsel, said that during the case of Mach Mining LLC v. Equal Employment Opportunity Commission, the Court will have the opportunity to decide “if the EEOC will became a totally closed and secret agency, with no ability for a court to review its compliance with congressionally mandated practices intended to promote voluntary employer compliance with Title VII.”

Oral arguments in the case are set for January 13.
