Don Livingston Weighs In on New EEOC Commissioner

Akin Gump labor and employment partner Don Livingston is quoted in Law360 discussing the newest commissioner on the Equal Employment Opportunity Commission.

Livingston, a former EEOC general counsel, says it is “hard to see the EEOC getting any more aggressive on systemic cases” following the Senate confirmation of Jenny Yang. Yang also gives the EEOC a full complement of five members, which Livingston says will make it easier for the commission to issue guidance in the future. He thinks the Americans with Disabilities Act “is the most obvious area where guidance might be expected.”
