Donald Livingston Quoted in SHRM Article on Prospects for EEOC Mediation Under Trump Administration
Akin Gump labor and employment partner Donald Livingston was quoted in the Society for Human Resource Management article “Expect More EEOC Mediation Under Trump Administration.”
According to the article, the Equal Employment Opportunity Commission (EEOC) will probably rely on more mediation in the next four years. One reason, it says, is because a Republican-majority commission could change its practices and allow all charges to go to mediation.
For some EEOC charges, Livingston, a former EEOC general counsel, said, the agency invites the charging party and the respondent to mediate soon after a charge is filed: “If the charging party and respondent agree to mediation, the charge is sidetracked off the investigation process.”
