Donald Livingston Talks to SHRM About Anonymous Hotlines and Harassment Claims

Akin Gump labor and employment partner Donald Livingston was quoted by SHRM for its article “Ford Settles Racial, Sexual Harassment Claims for $10M,” on a settlement the auto company made with the Equal Employment Opportunity Commission (EEOC).

Livingston, who is a former EEOC general counsel, noted that anonymous hotlines should not be the only channels available for employees to report problems. Although an anonymous hotline allows employers to receive more complaints and investigate problems earlier, he said, it’s more likely that the employer will not be able to corroborate an anonymous complaint—for example, the person cannot be questioned to provide any additional details that could establish the truth of the claim—compared to a complaint filed with an HR department or a manager.
