HazMat Management Magazine Publishes Akin Gump Article on COVID-19’s Impact on Environmental Site Assessments

Hazmat Management Magazine has published the article “The Phase I Environmental Site Assessment: Unexpected COVID-19 Victim?” written by Akin Gump environment and natural resources head David Quigley and associate Bryan Williamson, along with Summer Gell, a principal at Partner Engineering and Science, Inc.

The article, previously published as an Akin Gump client alert, looks at the impact of the coronavirus pandemic on the ability to conduct environmental site assessments (ESAs). Some states, the authors note, still allow ESAs to take place. Where they are permitted, though, “that does not mean it is business-as-usual.” In fact, the authors write, “commonsense efforts should be taken to minimize personal contact before, during and after site assessments.”

The article then looks at whether ESAs are legal in light of the current restrictions as well as whether they are useful.
