In Article, Akin Gump Litigators Examine Implications of UK Court of Appeal Ruling on Legal Advice Privilege

Practical Law, in a recent post to its Dispute Resolution Blog, has published the article “Implications of the judgment in Civil Aviation Authority v R (on the application of Jet2.com Ltd),” written by Akin Gump litigation partner Richard Hornshaw, counsel Tom Laidler and associate Srishti Kalro. The article, which was included in the publication’s Dispute Resolution blog, discusses a ruling by Britain’s Court of Appeal confirming that “the dominant purpose test, previously understood by some to be the sole domain of litigation privilege, also applies to legal advice privilege (LAP).”

The authors write that the decision means that “only those communications created for the dominant purpose of obtaining or giving legal advice will be protected by LAP.” They then examine some of the practical implications of the decision.
