In Government Contracting Law Report Article, Akin Gump Lawyers Analyze National Defense Authorization Act Interim Final Rule

Akin Gump international trade partner Kevin Wolf and government contracts partners Angela Styles, Robert Huffman and Scott Heimberg and associate Chris Chamberlain have written the article “Agencies Release Interim Final Rule Implementing First Phase of 2019 NDAA Section 889,” which was published in the Government Contracting Law Report.
The article analyzes an interim final rule pertaining to the National Defense Authorization Act of 2019 that would prohibit “federal agencies, federal contractors, and grant or loan recipients from procuring or potentially using—without a waiver or exemption—certain ‘covered telecommunications equipment or services’.”
The authors note that the rule imposes “significant, and in some cases novel, compliance obligations for U.S. government contractors and subcontractors.” As a result, anyone that sells “to the federal government directly or indirectly should immediately review and assess their exposure under the rule.”
