Law360 has published the article “Retail Loyalty Programs Will Survive Calif. Privacy Law,” written by Akin Gump litigation partners Seamus Duffy and Meredith Slawe, counsel Diana Schaffner, and associates Marie Bussey-Garza and Julie Busta. The article examines the impact of the California Consumer Privacy Act (CCPA) on retail loyalty programs.

The authors discuss a failed amendment to the CCPA, the new law that takes effect in January, that was “originally touted as saving retail loyalty programs from the reach of the CCPA’s nondiscrimination prohibition, [but] had morphed into a complicated safe harbor saddled with limitations.” As a result of the amendment’s failure to pass, they write, “retail loyalty and rewards programs should be able to find a natural home under the CCPA.”
