Jason Weil, counsel in the intellectual property practice at Akin Gump, has co-authored “Patent Eligibility and Experimental Use: An International Comparison,” which was published by The Naples Roundtable. The article examines the Supreme Court’s preemption concerns related to patentable subject matter. It then identifies foreign patent laws that codify (1) subject matter eligibility requirements and (2) experimental use exemptions to infringement that Congress may wish to consider as it examines revisions to Section 101 of the United States Patent Act.
