Law360 published an article by Ian Shavitz and Jason Hauter, senior counsel and counsel, respectively, in Akin Gump’s public law and policy practice, on the easing of regulations on tribal lands in order to spur renewable energy.

The authors write that two recent developments have played a big role: the Helping Expedite and Advance Responsible Tribal Home Ownership (HEARTH) Act, signed into law in July, and a rule issued by the Department of the Interior in November intended to streamline the development of solar and wind energy projects. Shavitz and Hauter observe that securing approval for commercial leases in the past has been a slow process.
