Leslie Kiernan Quoted by Bloomberg News on Possible Ethics Questions Involving FDA Commissioner Nominee
Bloomberg News has quoted Akin Gump litigation partner Leslie Kiernan in the article “Vaping Venture Poses Potential Conflict for Trump’s FDA Nominee,” regarding Scott Gottlieb, President Trump’s pick to lead the Food and Drug Administration, whom Kiernan represents.
The article reports that Gottlieb, if confirmed, would be in charge of implementing new rules governing the e-cigarette industry. From March 2015 to May 2016, however, Gottlieb served on the board of a company that sells vaping products, which could, the article says, pose a conflict as the FDA decides how vigorously to enforce new vaping rules that were issued last year.
Kiernan said that Gottlieb, if confirmed, “will undertake the duties of the FDA commissioner impartially and in the best interests of the American people.” She continued, “The Office of Government Ethics and the career ethics officials at the Department of Health and Human Services have certified that he is in compliance with all applicable laws and regulations and he will continue to follow those high ethics standards and this administration’s ethics pledge throughout his public service.”
