Michelle Reed, a partner in Akin Gump’s litigation practice who often advises public companies and their officers and directors in securities and privacy litigation, is quoted in the Agenda article “Boards Balance Opportunities and Risks of Big Data.”

The article addresses which safeguards boards of directors should put in place to deal with consumer privacy, how privacy and cybersecurity concerns differ and where companies should draw the line when it comes to leveraging the information they have collected on customers.

Regarding the potential legal fallout from a breach of private data, Reed said, “Even the most diligent companies, in trying to protect information, . . . they want to make sure they are prepared for what happens when something does go wrong.” She added, “The way companies and their directors are going to be judged is the way they are prepared for that.”
