Mike Warnecke Article on E-Discovery Risks Published by Corporate Compliance Insights

Corporate Compliance Insights has published “Top 5 e-Discovery Risks for 2013,” an article by Akin Gump litigation partner Mike Warnecke.

Warnecke observes that the unifying theme of what he identifies as the top five e-discovery risks for 2013 is overpayment.  As he notes, “The risk of paying too much arises from failing to take sufficient advantage of the competitive forces, process management techniques, software tools, opportunities for cooperation and procedural rules that are now available to reduce costs.”

Specifically, he outlines the five general areas where companies and law firms are not “taking full advantage of their ability to reduce e-Discovery costs”:

  • failing to delve into vendor selection and pricing
  • failing to utilize process management techniques
  • failing to use technology-assisted review
  • failing to cooperate
  • failing to use the discovery rules.
