National Law Journal Publishes Patterson and Friedman Article on Considerations for Workforce Reductions in Turbulent Times

“How to Effectively Manage Workforce Contraction in Turbulent Times,” an article by Akin Gump labor and employment partner Brian Patterson and associate Scott Friedman, has been published by The National Law Journal. The article, which is based on an Akin Gump client alert, examines some key considerations for companies that may be forced to implement workforce reorganizations or reductions.
Whether due to the coronavirus pandemic or the Russia-Saudi Arabia oil price war, when making plans to alter staffing levels, Patterson and Friedman write that “employers must tread cautiously.” Failing to comply with applicable statutes, they say, “can negate some of the anticipated savings and lead to litigation.”
The article then discusses some of the advance planning that can help minimize a company’s legal exposure when reductions in force are put in place. This includes selecting a restructuring team, being clear on business objectives, and analyzing potential discriminatory treatment or effect.
