Nowak begins with a discussion of a recent court decision by a Federal Energy Regulatory Commission administrative law judge, which raised questions about return on equity (ROE) for new transmission facilities. He later offers that if ROEs for such facilities were fixed on the basis of transmission developers’ market proposals or competitive bids, investors’ returns would remain stable.
