Rex Heinke Talks SCOTUS Dissents with Law360

For its article “The Sharpest Dissents Of The Supreme Court Term,” Law360 quoted Akin Gump Supreme Court and appellate practice co-head Rex Heinke on the tone of the dissents being issued by the Court’s more-liberal Justices.

The article notes that the dissents the Supreme Court issued this Term outpaced those of the preceding, and that their tone was sharper.

Heinke said that, with the retirement of Justice Anthony Kennedy and a predominance in the number of conservative Justices on the Court, the liberal Justices are signaling an “angry unhappiness” in the Court’s direction.

He noted, “The liberals on the court are afraid that with [Kennedy] gone, they will be consistently outvoted, and the tone of their dissents suggest that.”
