Texas Lawyer featured Akin Gump intellectual property practice head Steve Zager as its litigator of the week for a trade secret case he won in the Eastern District of Texas against the medical device manufacturer Globus Medical.

In the article, Zager described how he convinced the jury that Dr. Sabatino Bianco, an Arlington, Texas-based neurosurgeon, had wrongfully had his idea and product design for a device to be used in minimally invasive spinal surgeries misappropriated by Globus. Zager asked his client to perform a mock spinal surgery, which he explained, “made him into a teacher for the jury.” He added that he thought such a demonstration might work because most jurors are “visual learners.”

Zager, who secured his second jury trial victory in the Eastern District in the span of three months, was joined in the case by IP partner Chad Everingham, a former Eastern District judge making his first return in a trial to his former courtroom, along with partners Michael Simons and David Stein and counsel Emily Johnson.
