The Wall Street Journal has quoted Akin Gump international trade partner Stephen Kho in the article “Chances Fade for U.S.-China Trade Deal.” The article reports that the prospect of resolving the trade differences between Washington and Beijing is dimming as the Trump administration moves closer to striking a new North American Free Trade Agreement with Canada and Mexico.
According to the Journal, easing trade tensions with its neighbors to the north and south, along with a preliminary trade agreement with the European Union, have made it easier for the United States to push a multilateral front against China’s trade practices. Meetings on such a strategy have already taken place.
At the same time, however, several trade associations are considering suing the U.S. Trade Representative to block any new tariffs, by arguing that the administration has exceeded its legal authority and has acted arbitrarily. “There has been concern about the scope of authority for the president to move forward” with the additional tariffs, said Kho, a former trade official under Former President George W. Bush.
