Thomson Reuters Westlaw has published the article “Privacy versus pandemic: Health privacy considerations in response to COVID-19,” written by Jo-Ellyn Sakowitz Klein, senior counsel in the health care and life sciences practice at Akin Gump, and associates Mallory Jones and Caroline Kessler. The article, which originated as an Akin Gump client alert, examines some of the difficult privacy questions being raised by the coronavirus pandemic.

“Determining how much information to share regarding individuals affected by COVID-19, and with whom,” the authors write, “requires a fact-specific analysis under a patchwork of legal obligations.” This includes those related to privacy, public health and employment. The article then provides a framework for a course of action, highlighting some key considerations and best practices for those undertaking this complex analysis.
