Two at Akin Gump Named Among Top Health Industry Lawyers

(Washington, D.C.) – Nightingale’s Healthcare News has named Mark J. Botti and John R. Jacob of Akin Gump Strauss Hauer & Feld LLP as two of the top health industry lawyers of 2008, the firm announced today.

Mr. Botti was named to Nightingale’s list of 10 Outstanding Healthcare Antitrust Lawyers, while Mr. Jacob was named to the publication’s list of 10 Outstanding Healthcare Litigators.

Mr. Botti is a partner in Akin Gump’s antitrust practice group in Washington, D.C. He was recognized by Nightingale’s for his representations of a major trade association on health plan mergers with regard to the policy implications of DOJ antitrust investigations involving medical errors and a hospital in its capacity as a third-party witness to an FTC hospital merger challenge. Before joining Akin Gump in 2007, Mr. Botti served for 13 years at the Department of Justice in a wide range of litigation and policy positions within the Antitrust Division, including five years as chief of the Litigation I section. During his tenure, he litigated complex antitrust claims on behalf of the United States, bringing monopolization cases, horizontal conspiracy suits and merger challenges in some of the most vital sectors of the economy, including health care. Active in the American Bar Association, Mr. Botti is a vice chair of the Health Care and Pharmaceuticals Committee and is a co-editor of the health care portions of the Association’s Antitrust Law Developments VI (2007). He is a graduate of Dartmouth University and the Case Western Reserve University School of Law.

Mr. Jacob is a partner in Akin Gump’s health industry practice in Washington, D.C. He was recognized by Nightingale’s for his lead role in the 2008 negotiation of the largest reimbursement settlement ($660 million) in the history of the Medicare program; he was one of four court-appointed counsel in the settlement negotiations, which involved 300 cases and 700 hospitals nationwide and stemmed from changes to Medicare reimbursement policy made more than 20 years ago. In addition, he was cited for his representation of a large health care provider before the Provider Reimbursement Review Board $40 million in denied reimbursements. Mr. Jacob’s clients include multi-hospital health care systems, major academic medical centers and community hospitals. He is a graduate of Colgate University and American University’s Washington College of Law.
