Building Magazine has published the article “Witnesses – do we need them?” written by Akin Gump international arbitration and dispute resolution partner Hamish Lal.

In the article, Lal examines the value of witness evidence against documentary record through the rulings of Gestmin SGPS SA vs. Credit Suisse (UK) Ltd, Blue vs. Ashley and Kogan vs. Martin

Following the examination of these rulings, Lal suggests that witness evidence is likely most effective alongside documentary record, saying, “witness evidence may be most useful to the adjudicator, arbitrator or court when it is coherent or corresponding with the overall documentary record. Instead, regrettably, very often one sees witness statements that give mere opinions on what contracts or documents ought to mean.”
