The article addresses the Supreme Court’s recent decision in Federal Energy Regulatory Commission v. Electric Power Supply Association, which found that the commission (FERC) has jurisdiction under the Federal Power Act "to incorporate demand response into the organized wholesale electricity markets it regulates.”

Cannon and Brecher note that while the ruling was a victory for the demand response industry, it might also lead to increased FERC enforcement scrutiny of demand response activities.
