Akin Gump combines scientific knowledge and a strong understanding of the pesticide and chemical statutes, regulatory programs and exemplary litigation experience to assist clients throughout their engagement with the Environmental Protection Agency (EPA), including product approval and registration (or reregistration), compliance assistance and, when necessary, through the resolution of environmental enforcement actions. We assist chemical, energy and crop management and other industry players in maintaining compliance within a quickly shifting regulatory framework.

Our team helps clients establish rigorous programs that meet complex regulations while staying aligned with business strategies. We also advise industry-wide coalitions on presenting their messages to key regulators and lawmakers.

Our practitioners:

  • Advise chemical and petrochemical clients on pre-market notifications and exemptions pursuant to the Toxic Substances Control Act (TSCA).
  • Assist clients with the registration and reregistration of their new and existing pesticides at the federal and state level to allow for their sale and distribution, including ensuring compliance of marketing materials and claims and adherence to recordkeeping requirements.
  • Assist specialty chemical companies in matters concerning treatment, storage and disposal issues under the Resource Conservation and Recovery Act and state analogs.
  • Assist with TSCA and Federal Insecticide, Fungicide and Rodenticide Act (FIFRA) investigations and responses, and, when necessary, litigate matters in federal and state courts.
