Final Rule on Non-Discrimination Through Clinical Algorithms Pending at the OMB

Summary

The final rule will revise the implementing regulation for Section 1557 of the Affordable Care Act (ACA), which prohibits discrimination on the basis of race, color, national origin, sex, age, or disability in certain health programs or activities. The proposed rule, issued in July 2022, provided for the addition of specific language to bar discrimination through the use of clinical algorithms. Digital health stakeholders have expressed opposition to the AIspecific language.
